Terms of Service
Last updated: May 2025
These Terms of Service govern your engagement with Alpha Next Tech (“ANT”, “we”, “us”). By engaging us for software development work, you agree to the terms below.
1. Services
We design and build custom web applications, mobile applications, and websites. The exact scope, deliverables, and timeline of any engagement are agreed in a written quote or statement of work issued after a discovery call. Anything outside that written scope is treated as a change request and quoted separately.
2. Payment terms
Fixed-price engagements are typically invoiced 50% on acceptance of the quote and 50% on delivery, unless otherwise specified in writing. Monthly retainers are invoiced in advance. Invoices are due within 14 days of issue. Late payments may pause active work until cleared.
3. Intellectual property
You own all intellectual property in the deliverables we produce for you, including source code, designs, and documentation. Ownership transfers to you in full on payment of the relevant invoice. We retain the right to use general know-how, tools, and libraries that predate or are independent of your project.
4. Confidentiality
Any non-public information you share with us in connection with a project is treated as confidential. We will not disclose it to third parties and will use it solely to perform the engagement. We are happy to sign a standalone NDA before substantive project discussions on request.
5. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising from or related to an engagement is limited to the fees paid by you for that engagement in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including lost profits, revenue, or data.
6. Governing law
These terms are governed by the laws of Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
